Welcome to AteAI. Please read these Terms of Use carefully before using the app. By downloading, installing, or using AteAI, you agree to be bound by these Terms. If you do not agree, do not use the app.

1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and AteAI governing your use of the AteAI mobile application and any related services (collectively, the "Service"). By creating an account or using the Service, you confirm that you are at least 13 years of age and have the legal capacity to enter into this agreement.

2. Description of Service

AteAI is a calorie and nutrition tracking application that uses artificial intelligence to help users log meals, track macronutrients, set dietary goals, and monitor health progress. The Service includes:

• AI-powered food scanning via camera, barcode, voice, and ingredient input
• Calorie and macronutrient tracking and logging
• Personalized daily calorie and macro goal calculations
• Weekly nutrition analytics and AI-generated insights
• Water intake and weight tracking
• Push notification reminders

3. Accounts and Registration

3.1 Account Creation

You may create an account using your email address (via a one-time passcode) or your Google account. You agree to provide accurate and complete information and to keep it up to date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

3.3 One Account Per User

You may not create multiple accounts. We reserve the right to merge or terminate duplicate accounts.

4. Subscriptions and Billing

4.1 Free Trial

AteAI offers a 3-day free trial for new subscribers. The trial begins when you initiate a subscription purchase. You will not be charged during the trial period.

4.2 Paid Subscriptions

After the free trial, your subscription automatically renews at the applicable rate unless cancelled before the renewal date.

4.3 Billing

Payments are processed through the Apple App Store or Google Play Store using your payment method on file with those platforms. By initiating a subscription, you authorize the applicable platform to charge your payment method on a recurring basis.

4.4 Cancellation

You may cancel your subscription at any time through your App Store or Google Play subscription settings. Cancellation takes effect at the end of the current billing period. We do not issue refunds for partial periods except where required by applicable law.

4.5 Price Changes

We reserve the right to change subscription prices. We will provide advance notice of any price changes. Continued use after a price change takes effect constitutes acceptance of the new price.

4.6 Restore Purchases

If you reinstall the app or switch devices, you can restore a previous purchase using the "Restore Purchases" option in the app.

5. AI-Generated Content and Nutritional Information

5.1 Not Medical Advice

The nutritional information, calorie estimates, and AI-generated insights provided by AteAI are for general informational and wellness purposes only. They are not intended as medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before making significant changes to your diet.

5.2 Accuracy Limitations

Food recognition, calorie estimates, and nutritional data are approximations. Actual nutritional content can vary based on preparation, brand, portion size, and other factors. AteAI does not guarantee the accuracy of any nutritional data.

5.3 AI Insights

Personalized nutrition insights are generated by AI based on data you provide. These insights do not account for your complete health profile and should not substitute professional dietary guidance.

5.4 Barcode and Database Data

Nutritional data retrieved via barcode scanning is sourced from third-party databases (Open Food Facts and USDA FoodData Central). AteAI does not warrant the completeness or accuracy of third-party data.

6. User Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws
• Attempt to reverse engineer, decompile, or disassemble the app
• Use automated tools to scrape, crawl, or extract data from the Service
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to any portion of the Service
• Upload or transmit content that is harmful, offensive, or violates third-party rights

7. Intellectual Property

7.1 Our Content

All content, features, and functionality of AteAI — including text, graphics, logos, icons, and software — are owned by or licensed to AteAI and protected by applicable intellectual property laws.

7.2 Your Data

You retain ownership of the personal data you enter into AteAI. By using the Service, you grant us a limited license to process your data solely to provide and improve the Service, as described in our Privacy Policy.

7.3 Feedback

If you submit feedback or suggestions, you grant us an irrevocable, royalty-free license to use that feedback without restriction or compensation.

8. Third-Party Services

AteAI integrates with the following third-party services:

• Supabase — authentication and data storage
• Google Gemini — AI-powered food recognition and analysis
• RevenueCat — subscription and payment management
• Open Food Facts / USDA FoodData Central — barcode nutritional data
• Expo / Firebase — push notification delivery
• PostHog — anonymized usage analytics

Your use of these services is also subject to their respective terms and privacy policies. AteAI is not responsible for third-party practices.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy, which describes how we collect, use, and share your information. By using the Service, you consent to the data practices described in the Privacy Policy.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by applicable law, AteAI and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claims shall not exceed the amount you paid to us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless AteAI and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

13.1 By You

You may stop using the Service and delete your account at any time from the Settings screen within the app.

13.2 By Us

We reserve the right to suspend or terminate your account at our sole discretion, without notice, if we believe you have violated these Terms or if required by law.

13.3 Effect of Termination

Upon termination, your right to use the Service ceases. Provisions that by their nature should survive termination — including disclaimers, limitation of liability, and indemnification — will do so.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date. Material changes will be communicated via in-app notification or email. Continued use after changes take effect constitutes your acceptance.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of TN, United States, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the courts located in TN.
